That the complaint be and the same is allowed on contest with cost of Rs.10,000/- against the ops.

          Ops are directed to pay the total sum of Rs.3,24,600/- and also litigation cost of Rs.10,000/- as shipment within one month from the date of this order positively to the complainant by issuing a bank draft or bank pay order failing which for each day’s delay complainant shall have to get interest over the sum @ 12% w.e.f. date of the default or non-compliance of the order within the stipulated period as already fixed.

          For adopting an unfair trade practice for not settling the matter with the complainant, the op Air India shall have to pay a punitive damages to the extent of Rs.50,000/- to State Consumer Welfare Fund of this Forum within one month from the date of this order on the ground that ops harassed the complainant by adopting such unfair trade practice and to check up the habit of the Air India Authority, this punitive damage is imposed by this Forum.

          Ops are jointly and severally directed to comply the order and to implement the order within the specified period i.e. within one month from the date of this order and to satisfy the entire decretal amount within that period failing which penal action and criminal proceeding shall be started against them u/s 27 of C.P. Act 1986 for which further penalty may impose and even the Air India Authority may be sent to jail for implementation of this order.
