ORDER

Complainant Ramdeo Singh filed this case for a claim of Rs. 14,234/- (Fourteen thousand Two hundred Thirty Four), the cost of the ticket of Air India and compensation of Rs. 1,25,000/- ( One Lac Twenty Five Thousand) for each of the passenger with interest and litigation cost and further for written apology regarding not to repeat in future.

2          The fact of the case is that complainant purchased two tickets from Air Asia of travel from Delhi to Ranchi through IRCTC with his wife Mrs. Raj Alka.

            The travel date was 14-07-2018 from Flight No. 15-545 of AIR ASIA (India) having PNR NO. KU6HTX and scheduled departure was 11:45 A.M. from Delhi to Ranchi.

            Complainant with his wife reached Delhi Air Port (T-3) at 10:00 AM on 14-07-2018 and submitted bags at the counter of Air Asia (India) for weighing and boarding passes. Bags were moved on the belt and Boarding Passes were to be issued. But it was told that tickets were pre-pond for 12-07-2018, hence complainant could not take up the flight. The senior officer did not allow to take up the flight.

            Complainant had shown that he received message from IRCTC regarding schedule departure but all went unnoticed. Even copy of e-mail form Air Asia (India) as reminder of flight notice dt. 13-07-2018 at 1:00 PM, confirming the departure of flight on 14-07-2018, was shown to the officer of Air Asia (India) but he lady officer sitting at Boarding Pass issue counter had thrown away the copy and did not listen to him.

            Finally, on further enquiry, officer of Air Asia (India) had told that someone had pre-pond the tickets of 14-07-2018 to 12-07-2018 and conversation was recorded in their system. The complainant requested to give copy of the same but they refused.

            The further case is that on 09-07-2018 the office of the complainant enquired from AIR Asia for pre-pond of the journey and it was said that it was possible at additional Cost. Complainant further said that he contacted over phone from Haridwar and the cost of Rs. 7167/- was said to be additional charge for Pre-Pond which he declined and he received message of flight on 14-07-2018.

            The Complainant and his wife were humiliated even being senior citizen and harassed.

            Then he purchased two tickets from AIR India for Rs. 14,234/- (Fourteen Thousand Two Hundred Thirty Four) having flight No. A1-417 on 14-07-2018 for return.

            E-mail to Air Asia (India) on 17-07-2018 and reminder 20-07-2018 were sent but there was no response.

3          Complainant has filed 15 Annexures in support.

4          Opposite party AIR ASIA (India) Ltd. has not appeared even after the notice being served and as such ex- parte proceeding has been initiated.                           

F I  N D I N G S

5          We perused the record we hold that complainant having purchased tickets from O.P. through IRCTC portal is a consumer and dispute is a consumer dispute.

6          On perusal of the Annexures filed, it is clear that O.P. has Pre- Pond the journey of the complainant with his wife even after confirmed tickets for flight from Delhi to Ranchi without any pre notice. Even if it is taken to be true someone had Pre Pond the flight from 14-07-2018 to 12-07-2018 on telephonic conversation why no message has been received from O.P. on his registered mobile. This is certainly deficiency in service. The Complainant and his wife, being senior citizens, had to face harassment and humiliation for which O.P. is liable for compensation and return of the cost of tickets purchased from AIR India to return home.

7          In the result, we allow the claim of the complainant and O.P. M/S AIR ASIA (India) Ltd is directed to pay Rs. 14,234/- (Fourteen thousand Two hundred Thirty Four) with interest of 10 (Ten) % p.a. since 14-07-2018 till realisation.

            O.P. is further directed to pay compensation of Rs. 3,000/- (Three Thousand) with litigation cost Rs. 1,000/- (One Thousand) to the complainant.

            All the payment must be paid within 45 (Forty five days) from receipt of the order failing which the rate of interest shall be enhanced to 15 (Fifteen) % p.a. till realisation.

            Let a copy of this order be sent to O.P. at the cost of the complainant for compliance of the order.
