ORDER
Present complaint has been filed by complainant against OP alleging deficiency in service. The facts of the complaint are that the complainant has got the admission in the institute of OP (affiliated by Jodhpur National University) and on the assurance by OP complainant paid Rs. 6,000/- for the first and second year. Complainant submitted that on 08.07.2013 he had paid Rs. 6,000/- to OP for which he got an acknowledgment slip. OP assured to complainant that the complainant would get his Identity card and enrollment within next 10 to 15 days. However, after a few days, OP directed complainant to deposit Rs. 6,000/- for 3rd year failing which the Identity card and enrollment would not be issued to complainant. Complainant further submitted that he complied the directions of OP and deposited another Rs. 6,000/- with OP. OP again assured complainant to issue Identity Card and Enrollment within 10-15 days and also informed complainant that the examination would be held in December 2013 but complainant neither got his identity card and enrollment nor were there held any exams by OP till date. Further, complainant alleged that OP has wasted his whole year. Hence, the present complaint praying for directions to OP to pay the compensation for harassment and mental agony.
Notice of present complaint was served upon OP for appearing on 07.07.2014 however, OP failed to appear before the Forum and subsequently OP was proceeded against ex-parte vide order dated 21.07.2014
Complainant filed his Ex-parte evidence where he reiterated the contents of complaint and filed copy of fee receipts vide no. 1071 & 1032 dated 12.08.2013 & 08.07.2013 respectively for amounting to Rs. 6000/-each issued by OP.
We have heard the arguments addressed by the complainant and have also gone through the evidence submitted by complainant in support of his contention.
We are of the view that in the absence of any rebuttal by the OPs the complainant has succeeded in establishing the case of deficiency in service on the part of OP. Hence, we hold OP guilty of deficiency in service and direct OP to refund the entire amount i.e. Rs. 12,000/- to complainant. We also award Rs. 3000/- as compensation for harassment and mental agony inclusive of litigation expenses within 30 days from the date of order.
Let a copy of this order be sent to each party free of cost as per regulation 21 of the Consumer Protection Regulations, 2005.
