ORDER   PER  MR. S.M. SHEMBOLE , HON’BLE  PRESIDING MEMBER               None for the appellant is present. Its counsel Mr. Kharkate, Mr. Funde, and Mr. Shaikh are absent. Adv. Mr. Hitesh Verma for the respondent No.1 and Adv. Mr. Harinkhede for the respondent No.4 to 12 are present. Mr. Anil Gosavi, authorised person of the respondent No.2 and Mr. Khobragade, Secretary of the respondent No. 3 are present. The record reflects that nobody for the appellant is present since long. Therefore, on 26/04/2012 notice was issued to the appellant as well as respondents and in response to the notice the respondents appeared but nobody appeared for the appellant. No report about service of notice to appellant is received. However, the office copy of notice reflects that it was issued on the correct address of the appellant as shown in the appeal memo. Therefore it will have to be presumed that the appellant is served with notice but nobody turned up. Hence, the appeal deserves to be dismissed in default. Hence, it be recalled at 3.00 p.m. for order.               Matter is recalled at 3,00 p.m. but nobody for the appellant is present. Hence, the appeal is dismissed in default.
