1.       Mr. Premtosh Mishra, learned counsel appears for the petitioner / applicant.

          Ms. Rithumbhara Garg, learned proxy counsel appears for the respondent / non-applicant. She submits that she is making her submissions on instructions.

RA No. 167/2020 in RP No. 1447/2010

2.   The review applications no. 166 of 2020 and no. 167 of 2020 seek review of this Commission’s Order dated 07.01.2020 vide which revision petitions no. 1188 of 2010 and no. 1447 of 2010 were decided.

3.   Learned counsel for the petitioner / applicant and learned proxy counsel for the respondent / non-applicant both submit that the review applications may be allowed and the Order dated 07.01.2020 may be recalled. 

4.   In the wake of the above submissions, the Order dated 07.01.2020 is recalled. The revision petitions stand restored to their original numbers.

RP No. 1188/2010 and

RP No. 1447/2010

5.   Learned counsel for the petitioner submits on instructions that the petitioner wants to unconditionally withdraw its revision petitions no. 1188 of 2010 and no. 1447 of 2010 and does not wish to go into the issues on merits at all. 

Learned proxy counsel for the respondent submits on instructions that the respondent has no objection to the revision petitions being unconditionally withdrawn.  

6.   In the wake of the above submissions the revision petitions no. 1188 of 2010 and no. 1447 of 2010 are dismissed as withdrawn, without the option to file them again before this Commission.   

7.    The Registry is requested to send a copy each of this Order to the parties in the revision petitions and to their learned counsel. The stenographer is requested to upload this Order on the website of this Commission immediately.
