Ld. Advocate for the opposite parties is present.

Complainant is found absent on repeated calls without any step.

On perusal of order no.7 dated 25/04/2023 it appears that Ld. Advocate Ms. Chandrima Roy Chowdhury was provided to the complainant for his legal assistance from the Legal Aid Cell of this Commission but the complainant refused to take such assistance. Therefore, the Commission released Ld. Advocate Ms. Chandrima Roy Chowdhury from this case.

On the earlier date complainant refused to file any evidence by way of affidavit in chief and also submitted before the Commission that he will not be able to appear in this case any further.

It is apparent on the face of the record that the complainant has not proved his case by filing any evidence. So, we do not find any justification to proceed with the case any further.

Hence, it is

that the complaint case be and the same is dismissed for non-prosecution with cost.
