Present:             None for the complainant.

                        OPs No.1& 2 already ex-parte vide order dated                                     19.08.2021.

 

        Fresh address not filed. Perusal of the file reveals that on 01.03.2021, the complainant was directed to furnish the fresh address of OPs No.3 to 5 within 15 days and case was adjourned to 22.04.2021. On 22.04.2021 fresh address was not filed and case was adjourned to 30.06.2021. Again on 30.06.2021, 19.08.2021, 25.10.2021, 13.12.2021, 17.02.2022, the fresh address of OPs No.3 to 5 was not furnished and case was adjourned to 28.04.2022. On 28.04.2022 also the fresh address of OPs No.3 to 5 was not provided and the case was adjourned to 07.07.2022 subject to last opportunity. Pertinently, again on 07.07.2022 the fresh address of OPs No.3 to 5 was not filed despite last opportunity but in the interest of justice, the case was adjourned to 24.08.2022 for providing the fresh address of OPs No.3 to 5 subject to last opportunity. Today, despite the last opportunity, the fresh address of OPs No.3 to 5 is not provided. No justification has been provided for non furnishing of the address of OPs No.3 to 5. The complainant has neither provided the fresh address of OPs No.3 to 5 nor has given up them being unnecessary parties. Also none has been appearing on behalf of the complainant since 07.07.2022 nor any intimation has been received from him seeking leave to appear before the Commission. In these circumstances, we are of the view that no useful purpose is being served by repeatedly adjourning the matter for the same purpose. In our opinion, it would be appropriate to adjourn the case Sine Die till the correct address of the OPs No.3 to 5 is provided by the complainant to the Commission, and we order accordingly. However, it is made clear that the complainant shall be at liberty to get the present complaint restored at its original number as and when he is able to provide the correct address of the OPs No.3 to 5.
