This is a complaint filed under section 35 of Consumer Protection Act 2019 and the matter stood over to this date for consideration.After hearing the matter the commission passed an order as follows:

This is a complaint filed by the complainant against the opposite party alleging deficiency in service on the part of the opposite party.  There was delay in filing the complaint.  The complainant filed IA.449/2022 to condone the delay in filing the complaint.  Notice was issued to the opposite party in respect of delay petition and the opposite party filed objection.  After 26/08/2022 the complainant was continuously absent and not appeared before this Commission to further proceed with this complaint.  On the other hand the opposite party was present on all posting dates.  In view of the continuous absence of the complainant, we find that the complainant is not willing to further proceed with this complaint.     

In the result complaint is dismissed for default.  The complainant is directed to pay Rs.1,000/- (Rupees One Thousand Only) to the opposite party within 30 days from the date of receipt of this order. 

A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
