The case of the complainant is that complainant was an employee of the opposite party. The opposite party was not paid salary from 1.4.1999 to 1.4.2001. He is also entitled to get bonus, medical allowances and gratuity. Complainant made request in several times for getting the said amounts. The opposite party has not given the same. Hence complainant filed this complaint alleging the deficiency of service from the opposite party.
2. Notice was issued to the opposite party and entered appearance but they were not filed any version.
3. Considering the contentions of the complainant this forum raised following issues:-
Whether the complainant is entitled for compensation from the opposite parties establishing the deficiency as averred in the complaint?
4. Complainant given evidence and produced 1 document. The document produced by the complainant is marked as Exbt AI. Exbt A 1 is a service book of the complainant. On going through the service book of the complainant it can be seen that he was retired from service on 3.4.2001. So this Forum found that he is an employee of the opposite party and i) entitled to get arrears of salary and other benefits which would have been received at the time of retirement. The complainant claimed Rs.3,00,000- as the amount in due in various heads. But he was not produced the details with accurate Statement. Considering the facts and circumstances of this case we are directing the opposite party to pay the entire amount in due under various heads within 45 days from the date of receipt of this award. The complainant is also make a statement in detail to the opposite party showing the amount entitled to get from the opposite party within 15 days from the date of receipt of this award. If any dispute with regards to the amount and that can be agitated the execution petition. Hence complaint allowed. No order on cost.
