JUDGEMENT
The crux of the case is that the above named complainant alleging deficiency in service against afore mentioned O.Ps for non receipt of R.C. of bike Honda Activa 5 G Scooty bearing Regd. No. OD-18-G-5306 for which the complainant sought for redressal of the grievances raised by the complainant.
Being noticed the O.Ps appeared and filed written version.
Heard arguments from the complainant.. We perused the complaint petition and the documents filed by the complainant..
This District Commission examined the entire material on record and given a thoughtful consideration to the arguments advanced before us by the parties touching the points both on the facts as well as on law.
FINDINGS.
From the records it reveals that, the complainant had purchased Activa 5G (SCV110J) from the O.P. No.1 on Dt.11.12.2019 on payment of consideration a sum of Rs.58,493.00 which was financed by the HDFC bank, Rayagada bearing invoice No.OR23000119Vo1076 (copies of the invoice is available in the file which is marked as Annexjre-I).
The complainant during the course of hearing submitted at the time of purchase of above bike i.e. Scooty on Dt. 11.12.2019 she had paid the R.C. charges to the O.P. No.1 for delivery of R.C. to the complainant.
The main grievance of the complainant was that after purchase of the above bike till date she has not received R.C. from the O.Ps. Hence this C.C. case.
The O.Ps appeared and filed written version.
After filing of this case by the complainant before this Commission the Postmaster, Rayagada has put forth the speed post article No. EO480474462IN before the commission on Dt. 8.10.2021 mentioning the address change plea. The complainant has received the same from this commission with due acknowledgement on Dt. 8.10.2021.
On perusal of the speed post cover it is revealed that in the R.C. form mobile No. was mentioned but the R.T.O authority has not mentioned the mobile No of the complainant on the R.C. form so the postal authority has not contacted to the complainant to serve the same speed post articles to the addressee.
To meet the ends of justice, the following order are passed for the best interest of justice.
ORDER.
The R.T.O., Rayagada is directed to mention the mobile No. in the R.C. henceforth so as to enable to track by the postal authority to the consumers and to deliver the R.C. quickly to the public.
Parties are left to bear their own cost.
