CC/138/2021 is taken up  for  hearing and order.

 The contain of the complainant  under the petition is that this complainant  filed  the complaint on challenging  to the  validity , propriety  and bonafidenes  of the schedule mention policy of the complaint  on the ground that  the life insurance of the said policy holder neither appeared before the opposite party  nor signed on the said policy but the OP parties categorically denied the case  of the complainant  stating that without the presence  of the daughter of the complainant of namely  Miss  Sarawati  Hore,  in alive policy could not have been materialized .   So in view of that the original filled up Form along with this photograph of the schedule mention policy lying in the custody of the OP and they be directed  to produce those  before the commission along with the original earlier  policy  of the complainant ,Vide poly no 0045181819 issued 24.11.2020 under id number 2230005830 in order to show  that the OP parties collected the name of the present allege  policy owner  from the earlier  of policies  of the complaint .More over said original policy consist of photograph and signature  which become necessary to prove whether  the  clam of the OP is genuine or not .In view of that OP parties to be directed to produce the original proposal form of the schedule  mentioned policy and the earlier  policy of the complainant mentioned  above . 

The op parties raised objection in writing behind the petition stating that  this OP received  a duly filled up Electronically proposal format  singed by the customer  and declaration form for issuance of subject policy and along with KYC document and premium  amount .     So  basing on those documents  OP  issued the policy in favour   of the daughter of the complainant.   Since the proposal Form were filled up electronically  and   the applicant had signed  the customer  declaration  Form to the proposal Form after being  explained  about the contents of such proposal Form , those Forms  were attached with  W/V before honourable  commission   and annexure as  OP 1 and annexure OP 2 .    So the petition is subject to be rejected  because this OP  parties already filed a proposal Form and customer declaration Form along with written version .

 This commission perused  the petition and this objection and  the copies of filling documents  by the Insurance   company .   However insurance company  as OP  is directed to produce before the commission  the original filled-up Form  along with photograph of the  schedule  mentioned  policy if  lying to  their custody  as per petition.

Thus the petition date 23.02.023 under MA /16/2023 is disposed off .
