ORDER | ||||||
1. Counsel for OP No.1 has tendered one letter dated 11.01.2023 addressed to the complainant by OP No.1 Insurance Company informing her regarding reimbursement claim made, which is ordered to be placed on the file. 2. At this stage, the parties have settled the matter. Vide her separate statement, Ms.Archana Sharma, Counsel for OP No.1 has stated that claim amount of Rs.106349/- has already been paid to the complainant and the matter has been settled between the parties with the term that OP No.1 shall pay an amount of Rs.12,000/- as compensation/costs of litigation to the complainant as full and final settlement within three weeks from today failing which the OP No.1 shall be liable to pay the aforesaid amount of Rs.12,000/- alongwith interest @ 9% p.a. from the date of filing of present consumer complaint. Vide his separate statement, Sh.Abhishek Jindal, Counsel for Complainant has admitted the aforesaid statement of counsel for OP No.1 and prayed that the complaint be disposed off in terms of aforesaid settlement. 3. In view of the statements of the counsel for the parties and in terms of the settlement, the complaint stands disposed off by passing the following order:-
(i) The OP No.1 shall pay an amount of Rs.12,000/- as compensation/costs of litigation to the complainant as full and final settlement within three weeks from today i.e. 22.02.2023. (ii) In case OP No.1 fails to pay the aforesaid amount within the stipulated period, then OP No.1 shall be liable to pay the aforesaid amount alongwith interest @ 9% p.a. from the date of filing of present complaint i.e. 08.09.2022 till its realization.
4. The complaint is disposed off accordingly. 5. Certified copies of this order be sent to the parties free of cost. The file be consigned |
