ORDER   PER  MR. S.M. SHEMBOLE , HON’BLE  PRESIDING MEMBER   Appellant- Mr. Ashok Bhisikar is reported to be dead. On last date his brother Mr. Waman Janardhan Bhisikar appeared and sought time for appearance of LRs of the appellant but today nobody for the appellant is turned up. None for the respondent is also present. On 24/09/2012 notice was issued to the appellant as well as respondents and in response to notice appellant brother appeared on last date, but no report about service of notice to respondents is received. The office copy of the notice reflects that it was issued on the correct address of the respondents as shown in the appeal memo as well as in complaint. Therefore it will have to be presumed that the respondents are served with notice but they are absent. Therefore, the appeal deserves to be proceeded exparte. But since, the appellant is expired and his LRs did not turned up, there is no alternative except to dismiss the appeal as it is abated and accordingly it is dismissed. No order as to cost.
