Parties are present. Through the Op has not filed his Counter version, we have heard from parties at length.

It is ascertained from the submissions of the parties that the subject matter of the dispute does not comes under the purview of the C.P. Act, as the Complainant has not availed or hived any service from the Op. Through there is an agreement executed between the parties but the said agreements does not shows of reflect that the amount paid by Complainant is meant for availing any service or living any service from the Op and the Op is not rendering any service to the Complainant. Hence we do not think that subject dispute comes under the provision of the Act, 1980 and decided to drop the case.

Accordingly, the case is disposed off.
