This Miscellaneous Application has been registered in connection with CC 10/2021 on the prayer of the consumer complainant to prevent the OPs, namely, Addl. General Manager-cum-Project Manager (Electrical), Sai Computers Limited, Franchise of TSECL, Kailashahar Electrical I & II Divisions, Kailashahar, Unakoti District and another form disconnecting electric connection in the complainant’s premises.
Brief fact leading to the consumer complaint is that the complainant has been slapped with huge electricity bill of Rs. 23,000/- and Rs. 21,000/- respectively while generally she receives bills of Rs. 200/- to Rs. 700/- per month. The complainant claims that such inflated bill was not based upon actual consumption or on actual meter reading, but based upon surmises and conjectures of the OP No. 1, which is the sole franchise of TSECL for Kailashahar region. Admittedly, the OPs are the lone service providers and electricity is an essential service, the disconnection of which will cause immense difficulties for the consumer. The bills also appear to be highly inflated.
Situated thus, in terms of section 38(8) of the Consumer Protection Act, 2019, this Consumer Commission is empowered to pass interim order.
It is hereby ordered that the OP No. 1, Addl. General Manager-cum-Project Manager (Electrical), Sai Computers Limited, Franchise of TESCL, Kailashahar shall refrain from disconnecting the electric connection in the premises of the complainant, Smti. Minakshi Kar, wife of Shri Anup Kar of village –Gobindapur (Ishwar Chandra Vidyasagar Lane), PO & PS – Kailashahar, District – Unakoti until further order.
Inform accordingly.
Put up along with CC 10/2021 for further order.
