This complaint is coming up before us for final hearing on 22-06-2009, in the presence of Sri G. Ramulu, Advocate for complainant and opposite party, and on perusing the material papers on record, and having stood over for consideration till this day, the Forum passed the following:
::ORDER::
1. The averments in brief of the complaint are that the complainant is the resident of 1-1-174 Korutla Town. He is a Wood Cutter by profession. He obtained permission from all the departments concerned like Department of Forest, Government of A.P., Department of Industry, Government of A.P., and Town Municipal, Korutla to start a Saw Mill in the name and style of ROSE FLOWER SAW MILL at H.No.6-1-57, near Gadi at Korutla Town. When he made application to opposite party in the month of February, 2009 requesting to provide electricity connection to the above Saw Mill after payment of requisite fee, they did not provide connection. Hence, this complaint and prayed t direct the opposite party to provide immediate service connection to his Saw Mill at Korutla and Rs.10,000/- towards damages and costs of the complaint.
2. No counter or Proof of Affidavit filed by the opposite party.
3. The complainant filed his Proof of Affidavit reiterating the contents of the complaint and marked the documents as Ex.A1 to A5. Ex.A1 is the Xerox copy of License for Establishment and Running of Saw Mill/Saw Mill and Depot Dt. 29-1-2009. Ex.A2 is the copy of acknowledgement issued by Department of Industries Dt. 24-2-2009. Ex.A3 is the copy of miscellaneous receipt showing the payment of requisite fee in Municipal Council, Korutla Dt. 6-12-2008. Ex.A4 is the copy of No Objection Certificate issued by Municipal Council, Korutla Dt. 16-12-2008. Ex.A5 is the copy of D.D (No.623775) showing payment of Rs.1,500/- to DEE/OP/APNPDCL, Jagtial Dt.18-2-2009.
4. Now the point arises for consideration is whether the complaint is liable to be allowed?
5. From the above referred facts there is no dispute that the complainant is in occupation of H.No.6-1-57 at Korutla Town. He obtained permission from all the departments concerned like Department of Forest, Government of A.P. under Ex.A1, Department of Industry, Government of A.P. under Ex.A2, No Objection Certificate from Commissioner, Municipality under Ex.A4 for establishing ROSE FLOWER SAW MILL in the Municipal premises No.6-1-57. He also paid requisite fee and he applied for service connection to the said premises. But after paying necessary fee under Ex.A5, since the opposite party did not provide any service connection this Court directed the opposite party in I.A. 44 of 2009 to provide service connection to the premises no.6-1-57 and accordingly the opposite party complied the order of this Court. Since the complainant approached after compliance of legal formalities absolutely no reason for the opposite parties to delay in providing the connection. Any how the relief sought for by the complainant is complied by opposite parties, the complaint is allowed to the extent of relief of providing service connection to ROSE FLOWER SAW MILL and the remaining reliefs are dismissed. No order to costs.
