Both parties file hazira through Advocate.

Written Argument with loan account statement of the Complainant issued by Bajaj Finance Limited is filed on behalf of the O.P. No.2/ Bajaj Insurance Company Ltd

No step is taken by O.P. No.1.

The case is fixed for argument.

The instant case has been filed by the Complainant against the O.P. for restoration of civil score with compensation. It appears from the record that the Complainant has a loan account with Bajaj Finance  Ltd  for purchase of some electronic gadgets from O.P. No.1 but in spite of payment of the loan amount save and except a small amount the complainant has been displayed as a defaulter of loan in the civil score. In fact the relief has been sought against the lender i.e. Bajaj Finance Ltd. but through an inadvertence Bajaj Insurance Co. Ltd. has been added as O.P. No.2 along with O.P. No.1

Ld. Advocate for O.P. No.2 filed written version as well as written argument with the sole contention that the case is not maintainable against Bajaj Allianz General Insurance Co. Ltd. which is an Insurance Co. and not connected with the transaction of the case.

Ld. Advocate for the Complainant submits before the Commission that a fresh complaint may be filed against proper party with proper relief for which liberty is sought for.                                                                                                                          

Hence it is ordered…….

That the case be and the same is dismissed on contest but without cost.

The Complainant is given liberty to file a fresh complaint on the same cause of action against the necessary party with proper relief.

Both parties be supplied copy of this Order free of cost.
