Final Order / Judgement

Heard oral argument put forward by the Ld. counsel for the complainant. We have also perused written argument as well as the complaint petition and the evidence on affidavit on the record.

The case of the complainant in brief is that Opp. Party A.D Photography, Karimganj was engaged to cover the wedding ceremony of marriage of the complainant solemnized on 14/02/2021 by video recording and to take photo shot. The O.P demanded Rs.18,000/- (Rupees eighteen thousand) only as consideration. The complainant paid an amount of Rs. 16,000/- (Rupees sixteen thousand) only and it was agreed that at the time of delivery of video graphs and photographs remaining Rs. 2000/- will be paid  but after elapse of 6 months the O.P did not hand over  the video graphs of ceremony of the complainant  and also did not return the money. When contacted the O.P informed that the video graphs had been deleted by mistake. Hence, the case. The complainant has submitted his evidence on affidavit and has also exhibited the documents in respect of payment of Rs. 16,000/-. The O.P did not contest the case.

 

From the materials on record it has been established that the O.P has caused disservice by not handing over the video graphs and also by not returning the money.

  

Under the circumstances we are of the view that the complainant is entitled to get the relief in the case.

 

Accordingly, it is ordered that the O.P shall pay to the complainant an amount of Rs.16,000/- (Rupees Sixteen thousand) only with interest @ 8% per annum from the date of payment till today. The O.P shall further pay an amount of Rs. 5,000/- (Rupees five thousand) only as compensation for mental agony pain and harassment and another amount of Rs. 5,000/- (Rupees five thousand) only for cost of the proceeding. The O.P shall pay the entire amount within a period of 60 (Sixty) days else interest will accrue on the entire amount @ 10% per annum from the date order till realization.
