J U D G M E N T
        No step from complainant is present.
        Heard argument.
        Gone through the case record. 
        Case is filed by one Goutam Saha against Monoj Kumar Kotharithe Proprietor  of Action Show Room, HGB Road, Agartala and also T.C. Jaha Retail Ventures Pvt. Ltd., New Delhi.
        Notice  sent to the O.P. but O.P. did not turn up inspite of notice. Petitioner produced the vouchers also examined one witness. We have gone through the evidence given and now shall decide the matter.
    
        Findings and Decisions:

        From the complaint and evidence of the petitioner it is found that on 08.02.16 petitioner purchased a pair of shoes from the Action Shoes, HGB Road, Kaman Chowmuhani, Agartala on payment of Rs.500/- on discount. Shoe was found torn. It was not in a position to wear. So, on the next day he went to the O.p. for changing it. He was ready for payment on excess amount for taking another show but the owner of the shop misbehaved. 3/4  times he talked to the customer care centre. Customer Care Centre requested the Proprietor to change the shoes but the Proprietor refused. The Vouchers is produced  to support the purchase from the Proprietor. Monoj Kumar Kothari. It is found that he was unfair trade practice at Agartala. O.P. No.2. T.C. Jaha have no role in this matter but the proprietor of Action shoes who refused to change the torn shoes on the next date definitely responsible  for and charged against his establishment. We find that he was doing unfair trade practice by selling defective tron shoe. Therefore, petitioner is entitled to get compensation and replacement of the shoes by better one. We direct the Proprietor of Action shoes Monoj Kothari to replace the shoe and also to pay Rs.5,000/- to the petitioner as compensation for his unfair trade practice. The amount is to be paid within 2 months if not paid it will carry interest @9%P.A.
