COMMON ORDER IN CONSUMER COMPLAINT NO.CC/14/529 + CONSUMER COMLAINT NO.CC/14/530

In both these consumer complaints, we have heard learned Adv. Smt. Jayshree Sandeep Kulkarni on behalf of the Complainants and learned Adv. Smt. Sukruta A. Chimalker on behalf of the Opposite Party at length. With their help, we have also carefully scrutinized the entire material placed on record.
[2] In reply to query by this Forum, during the course of her oral submissions learned counsel for the Complainants fairly submitted that both these consumer complaints are beyond the pecuniary jurisdiction of this Forum and prayed that both these consumer complaints may be returned for presenting these consumer complaints for presenting before appropriate Forum/Commission having competent jurisdiction to entertain, try and decide these consumer complaints.
[3] Thus, in view of pecuniary jurisdiction of this Forum, as culled out under the provisions of Section-11(1) of the Consumer Protection Act, 1986 and in view of submissions made at the Bar by the learned counsel for the Complainants, Consumer Complaint No.529 of 2014 as well as Consumer Complaint No.530 of 2014 are hereby returned to the Complainants for presenting these complaints before the appropriate competent Forum/Commission, within a period of thirty days from the date of receipt of this order. Upon retaining one complete set of compilation of consumer complaints, remaining sets shall be returned to the Complainants for presentation of the same before competent Forum/Commission in pursuance of foregoing order. Both these consumer complaints accordingly stands disposed of. No order as to costs. Original copy of foregoing order shall be retained together with record & proceeding in Consumer Complaint No.529 of 2014 and certified copy thereof shall be tagged together with record & proceeding in Consumer Complaint No.530 of 2014.
