Heard on Admission.

It is the complaint of the complainant that he has purchased a Insurance policy w.r.t. his WagonR car valid from 23.12.2022 to 22.12.2023 and he raised a claim on 06.08.2023 w.r.t. certain damages in the car which was rejected vide email dated 0808.2023 but simultaneously it was informed that a surveyor would be appointed and accordingly one Sh. Gaurav Sharma was appointed who told the Complainant to visit the authorized service centre of OP and get a quotation of the proposed repair which was given as Rs.56,110/- but the same was also not approved and complainant was directed to visit another service centre and accordingly he visited Magic Auto Pvt. Ltd. who gave a different report than what was given by earlier authorized service station i.e. Fair Deal Premium Wheel and in last two months Complainant and his brother are running from pillar to post but the OP instead of resolving the problem is aggravating the same and is time and again calling for estimated cost of the damages.  Aggrieved from this fact complainant has issued legal notice dated 04.09.2023 but the same was not complied with and has filed the present complaint thereby seeking that OPs be directed to repair the damages in the above mentioned or to clear the damage estimate cost of Rs.50,000/- with interest @ 24% p.a. along with compensation of Rs.10,000/-. 

The Comission has heard the arguments and perused the record.

The case basically is w.r.t. the repair of certain damages on the basis of quotations.  The Commission specifically enquired that since the insurance policy covers / indemnifies the damages spent by the insured on the vehicle and since there is no amount spent so far and these are only the quotations which may increase after thoroughly inspecting the vehicle to which AR of the complainant submits and rather concedes that no amount has been spent so far for repair of the damages.  Therefore the commission is of the opinion that the Commission cannot admit this complaint for paying Rs.56,110/- which still has not been spent or with interest or with compensation as well. 

Complaint  therefore appears to be pre-mature and therefore is rejected.
