The case record of this case shows that in this case the opposite party appeared on 06.12.2014 on the day when National Lok Adalat was held and filed one petition for time but thereafter the o.ps not taking any element and accordingly the case is fixed for ex. Parte hearing .
The present case was filed by the complainant who was a consumer of Telephone department and was running STD booth and his connection no. 0652522623. The complainant contended that fulfilling all the conditions imposed by the C2 . M. Telephone Telecom District Ranchi and pay security of Rs. 5000/ on 30.04.1998 . The complainant connection to contended the he surrendered the said connection to S.D.E telephone simdega and requested the office to disconnect the same in 30.06.2007 and requested to refund the security money. When the complainant was advised to approach the account section of Bharat Sanchar Nigam Limited (TRA) Ranchi. The complainant further contended that the complainant approached the account section of BSNL (TRA) Ranchi.
The complainant sent advocates notice on 13.10.2014 and has filed this case with prayer to grant value of the goods for Rs. 5000/ with interest of 12% per annum from the date of filing of the claim petition dated 18.02.2009, Rs. 25000/ for cause mental agony and Rs. 10000/ as litigation cost and other relief .
Surprisingly the S.D.E legal o/o the C2 MTD Ranchi filed one petition on 5.12.2014 praying for one month time to file written statement but till today none appeared on behalf of the opposite parties have nothing to state anything against the claim of the complainant.
Considering the facts and deposited demand note of Rs. 5000/ the last metre reading and obtained no dues certificate from account section of BSNL (TRA) Ranchi and submitted application to refund the security money on 18.02.2009. It is further contended that after taking ‘no dues’ certificate the o.p1 again sent till work Rs. 5406/ on 18.10.2010 vide letter no TRA 14/refund /226237 with outstanding bill detailed. Given in the petition. It is further contended that the complainant again sent a letter on 20.12.2010. But the ops did not take any notice on the otherhand a Letter was sent to the complainant to compromise the case on payment of Rs. 5506/ at Mega Lok agalat on 29.08.2014 where the complainant explained all circumstances. But the officer of the BSNL did not listen the grievances of the complainant. the forum have no option but to allow the prayer of the complainant and Accordingly.
The opposite parties are directed to refund the security money of Rs. 5000/ only with interest at the rate of 12% per annum from the date of filling of the case i.e, 17.11.2014 till realization of the same .
The opposite parties are also directed to pay Rs. 5000/ for causing mental agony to the complainant and also directed to pay Rs. 5000/ as litigation cost .
The opposite parties are directed to pay all the amount to the complainant within sixty days of receiving of the order. Failing which the opposite parties have to pay inhand at the the rate of 12% per annum.
