Today is fixed for hearing of the Ld. Advocate on the point as to admissibility of the complaint. But the Ld. Advocate of the complainant is absent.

The statutory period of 21 days expires today. Therefore there is no scope for adjourning this matter to some other date.

The copy of agreement on the basis of which the case has been filed is not found in the record. The nature of intended service has not fully been disclosed. We are unable to get the same from the four corners of the petition of complaint. Payment of Rs. 18,000/- which was made by the complainant to the OP is not reflectedf in any other document save and except the complaint. In the absence of (a) money receipt, (b) clarity in unfolding the complainant’s case in proper sequence we have no option but to treat the complaint as most unwelcome and unimpressive. In such a case no relief can be granted.

Such being the position, we are of the view that the case should be dismissed as being not admitted.

Hence, it is ordered, that the case be and the same is dismissed as not being admitted.

Let a plain copy be given to the parties free of cost as per CPR.
