Both sides are present through their respective Ld. Counsels.

Being aggrieved by and dissatisfied with the order no. 6 dated 17.08.2022 passed by the Ld. DCDRC, Unit—IV, Sealdah in Complaint Case being no. 47/2022 observing that the case shall proceed ex parte against the OP, Revisionist/OP preferred this Revision Petition.

In the aforesaid order the Complainant was directed to show cause as to why the complaint case shall not be dismissed for default.

It is submitted that in terms of the order no. 6 dated 17.08.2022 the Complainant has already filed a petition showing cause before the Ld. Commission below and the show cause petition was accepted by the Ld. Commission below.

Ld. Counsel for the OP submitted that she could not file written version before the Ld. Commission below and he is willing to contest the case and he prayed for appropriate direction for allowing her to file written version. It appears from the revision petition that the matter was mis-placed by the Officer of the company concerned. So, the party could not take any appropriate steps. It appears that the Revisionist/Petitioner is willing to contest the case before the Ld. Commission below. So, we are of the view an appropriate opportunity should be given to them.

With the above observation, the Revision Petition being no. 110/2022 is allowed subject to payment of cost of Rs. 1,500/- payable to the Respondent. The cost is to be paid on that day.

The parties are directed to appear before the Ld. Commission below on 13.12.2024.

The OPs shall file written version on that date.

Ld. Commission below shall dispose of the case in accordance with law within 90 days from the date of appearance of the parties without being influenced by the observations made by this Court.

The impugned order is set aside accordingly.

Revision Petition being no. 110/2022 stands disposed of.
