          A petition U/s 38(8) of the C.P. Act, 2019 is filed on behalf of the complainant praying for restraining the OP side from transferring the ‘B’ scheduled property in the petition to the third party in prohibitory form stating the ground therein. This petition is registered as M.A. being No. 95/2020.The petition is moved . Heard. Perused the petition alongwith complaint.

The Consumer Protection Act, 2019 stands in summary procedure and it requires trial of completion within 90 days. The procedure is very simple and easy as well as speedy. If any party be injuncted in that event there is every possibility of violation which creates delay in disposing the case which surely frustrates the purpose of the Act. Therefore, it is unwise to allow such type of prohibitory prayer (interim injunction).

 

          Hence, the instant petition is considered and rejected.

 

Thus, the M.A. being No. 95/2020 is disposed of.
