Present:       Ms. Devna Arora, Counsel for the Appellant along with Sh. Atul Shrivastava, AR of the Appellant.

                     Sh. Abhaya Jain, Respondent in person.

 

 

        It is stated that the matter has been amicably settled between the parties. The settlement terms dated 28.05.2015 in writing duly signed by both the parties are also placed on record.

        Sh. Atul Shrivastava, AR of the appellant who has signed the aforesaid settlement is present and he identifies his signatures at point A on each page of the settlement. Respondent also identifies his signature on aforesaid settlement at point B on each page.

        The settlement is exhibited as Exhibit C-1.

        In pursuant to settlement Exhibit C-1 a cheque of Rs. 3,38,813/- has been given by the respondent to the appellant after deducting  TDS. Photocopy of the same is placed on record.

        In terms of settlement, the appellant has accepted the aforesaid payment in full and final settlement of their claims with the respondent with regard to allotment of parking space and it is stated that aforesaid payment will not be considered as delayed payment for parking space as per terms of Apartment Buyer Agreement.

        It is stated that as the matter has been amicably settled between the parties, the impugned order be modified in terms of settlement Exhibit C-1.

        In view of the above settlement between the parties, the impugned order stands modified in terms of settlement dated 28.05.2015 Exhibit C-1.

        Appeal stands disposed of accordingly.

        Parties shall remain bound by their respective statements.

        File be consigned to record room.
