ORDER

Respondent/complainant’s daughter successfully completed 10th standard.  Respondent requested the petitioner to issue Transfer Certificate, 10th Mark Sheet, Pass Certificate and Migration Certificate of his daughter but the petitioner refused to issue the same on the ground that there is a condition in the prospectus that a student who

has joined in Class 8th has to pay the entire fee up to 12th Standard if the student wishes to leave the school before completion of                    12th Standard.

          Respondent being aggrieved filed the complaint before the District Forum.

          District Forum keeping in view the fact that if the Transfer Certificate, 10th Mark Sheet, Pass Certificate and Migration Certificate are not issued to the complainant’s daughter she would lose one year passed an interim order directing the petitioner to issue Transfer Certificate, 10th Mark Sheet, Pass Certificate and Migration Certificate.

          Petitioner being aggrieved filed the appeal before the State Commission which has been dismissed.

          The fora below have rightly directed the petitioner by the interim order to release the Transfer Certificate, 10th Mark Sheet, Pass Certificate and Migration Certificate, otherwise the student would lose an academic year.  We are not inclined to interfere with the just

interim order passed by the fora below.  Revision petition is dismissed.

          However, the interim order shall be subject to the final outcome of the complaint.
