Mr. Aalok Kumar Srivastava, learned Counsel for the revisionists appeared.
Heard learned Counsel for the revisionists and perused order dated 01-06-2017 passed by the District Consumer Forum, Varanasi in Complaint Case No. 313/2013 Abdul Quddus Ansari V/s Sahara India Commercial Corporation Limited and another whereby the District Consumer Forum has rejected application moved by revisionists who are opposite parties in said complaint with prayer to recall order dated 11-11-2016.
In view of provisions contained in the Consumer Protection Act 1986 as well as proposition laid down by Hon’ble Apex Court in the case of Rajeev Hitendra Pathak and others V/s Achyut Kashi Nath Karekak and another reported in IV(2011) CPJ 35(SC) the District Consumer Forum

has no jurisdiction to recall or review its order passed earlier. As such, rejection of application moved by revisionists for recalling previous order passed by the District Consumer Forum cannot be said to be against law.
In view of above revision is dismissed with liberty to the revisionists to move revision in accordance with law against order dated 02-04-2016 passed in above complaint.
Let copy of this order be made available to the revisionists as per rules.
