          Heard.  Appeal admitted.  It is seen from the records that the Appellant was set exparte by the Forum.  Taking into account the nature of contentions raised by the parties,  I feel that an opportunity should be given to the Appellant to contest the matter on merits.  Hence appeal has to be allowed.  The Appellant shall pay cost of Rs.3,000/- (Rupees three thousand only) to the complainant.

          In the result, appeal is allowed.  The impugned order of the Forum allowing the complaint is set-aside.  The matter is remanded to the Forum for fresh disposal in accordance with law.  On receipt of this order Forum shall issue notice to the complainant.  The Appellant shall appear before the Forum on 30/03/2017 Forum shall proceed with the case in accordance with law after receiving the written version of Appellant.  Appellant is  permitted to pay the cost to the complainant from the Forum..
