Sri Sanjeev Bahadur Srivastava, learned Counsel for revisionist appeared.

Heard learned Counsel for the revisionist and perused impugned order dated 03-02-2017 passed by District Consumer Forum, Varanasi in Complaint Case No. 243/2014 Abdul Kabir V/s Bajaj Allianz Life Insurance Company Limited whereby the District Consumer Forum has rejected application moved by opposite party who is revisionist in this revision to recall exparte order and to admit his written statement on record.

The impugned order passed by District Consumer Forum cannot be said to be against law but in view of pronouncement of Hon’ble Apex Court in the case of Reliance General Insurance Company Limited and another V/s M/s. Mampee Timbers and Hardwares Pvt. Ltd. and another Civil Appeal No…….of 2017 (D. No. 2365 of 2017) revisionist has liberty to move application before the District Consumer Forum for permission to file written statement after condoning delay.

In view of above the revision is dismissed with liberty to the

revisionist to move application before the District Consumer Forum for permission to file written statement in the light of proposition laid down by Hon’ble Apex Court in the above case. If such application is filed before the District Consumer Forum within 30 days from today, the District Consumer Forum shall pass appropriate order in the light of above pronouncement of Hon’ble Apex Court positively within 15 days from the date of application.

Let copy of this order be made available to the parties within 15 days positively as per rules.
