Anil Verma Vs. Aarti Agencies and another

Present: Complainant in person with Shri Vipin Sharma, Advocate. 

                          OP No.1 already ex parte. 

                          Shri VK Sharma, Advocate for OP No.2.

 

                     Today this case is fixed for filing evidence by the complainant. Counsel for the complainant has tendered into evidence affidavit of complainant as Annexure CA along with documents Annexure C1 and C2 and closed the evidence on behalf of complainant. Shri VK Sharma, Advocate has appeared on behalf of OP No.2 by filing memo of appearance and made a statement that OP No.2 – Company is ready to replace the Washing Machine in question with new one of the same model and if the same model is not available due to some reasons then it will be replaced with the model of same features and same price. The company will receive the old washing machine after replacement with new one and sought 20 days time for compliance of the order. 

 

                       On the other hand, complainant has made a statement to the effect that he has heard the statement of counsel of OP No.2 and accept the same and prayed for withdrawl of the complaint. 

   

                        Keeping in view the statements made by both the parties, the OP No.2 is hereby directed to replace the Washing Machine of the complainant with new one of the same model and if the same model is not available then it will be replaced with the model of the same features and same price within a period of 20 days from the preparation of copy of this order. Both the parties are bound to abide by their respective statements. If the OP no.2 fails to comply with the abovesaid order then in that eventuality, OP No.2 is liable to pay compensation amount to the tune of Rs.2000/- to the complainant in addition to the replacement of the washing machine as directed above. Hence, the present complaint is hereby dismissed as withdrawn being compromised. Copy of this order be supplied to the parties free of cost and file be consigned to the record room after due compliance.
