Today is fixed for hearing of this M.A. case, W/O, if any, in the meantime. Applicant-Bank Authority is found present. O.p. is also found present. Heard both sides. Considered submission.

This M.A. case has filed by the O.p.no.3-Bank Authority for setting aside ex-parte order and for acceptance of w.v. No W/O has been filed against this M.A. case.

After going through the materials of the case record it appears that O.p. no.3-Bank Authority is a necessary party of this case and his presence is required for the interest of proper and complete adjudication of this case.

So, the M.A. case is allowed on contest.

Let the order of ex-parte hearing against O.p. no.3 is set aside and w.v. filed by O.p. no.3 is to be accepted subject to payment of cost of Rs.1,500/- (out of which Rs.1,000/- is to be paid to the complainant and Rs.500/- is to be deposited in the Consumer Legal Aid account of D.C.D.R.C., Howrah). In the light of the observation this M.A. case is disposed of.
