Pushwinder Singh vs.  Aadesh Communication etc.

       Present:-         Complainant in person with Sh. Shiv Bishnoi, Advocate.                                        

                          Ops no.1 and 2 already exparte.                                     

                       Sh. A.S. Kalra, Advocate for op no.3.   

                      File put up today on the application moved on behalf of complainant for recording statement of parties as per settlement between complainant and op no.3. Learned counsel for op no.3 has also suffered a statement that the company is ready to pay full and final payment of Rs.1,35,000/- i.e. 90% of billing amount of product value as per settlement with the complainant within two months and complainant be directed to deposit the mobile phone alongwith original accessories alongwith cancelled cheque and copy of adhar card to op no.2 service center of company, so as enable company to process payment. Complainant has also suffered a statement that compromise has been effected with op no.3/ company and as per compromise, op no.3 is ready to pay 90% of billing amount i.e. Rs.1,35,000/- on account of full and final settlement of the mobile phone within two months and complainant will deposit mobile set alongwith original accessories alongwith cancelled cheque and adhar card with op no.2 within 10 days and complaint may be disposed of. He has further stated that in case op no.3 fails to pay the above said amount within above said period, then op no.3 may be directed to pay interest on the above said amount.

             In view of the statements of learned counsel for op no.3 as well as complainant, present complaint is disposed of accordingly being compromised and op no.3 is directed to pay the above said amount of Rs.1,35,000/- being 90% of the bill amount of product as full and final payment as per settlement to the complainant within two months from today, failing which complainant will be entitled to receive the above said amount of Rs.1,35,000/- from op no.3 alongwith interest @6% per annum from today till actual realization. The complainant as well as op no.3 shall also be bound down by the statements recorded today. File be consigned to the record room
