After going through the complaint and annexures and as argued by the Counsel for complainants, admittedly neither OP works for gains nor property in question situates within the jurisdiction of this forum. Counsel for complainants states that cause of action partly arose within the jurisdiction of this forum on the ground that the application for allotment was signed and the payment of initial amount for booking the property in question was made at the residence of the complainant but Counsel for complainants has shown nothing to substantiate his contention of signing the application and payment of initial amount of booking at complainant’s address. Hence he has failed to prove that cause of action partly arose within the jurisdiction of this forum. Hence this forum has no jurisdiction to entertain the present complaint and the same is dismissed in limini with the liberty to the complainants to file the same in appropriate forum.
