Accused is produced.  He does not comply any ill treatment. Accused submits that his plea may be recorded. Hence, plea of the accused is recorded.  Plea of guilty is accepted.

It is seen that in CC No. 87/2011 on 27.06.2011 this Forum had directed the accused to recover certain amount in installment from the salary of A. Satish Babu and pay it to the Complainant.  In spite of that and in spite of this Execution Application 43/2012, accused has failed and omitted to comply with the Order.  Now, the Complainant filed a Memo which reads thus:

“The Decree Holder above named submits this case has been settled out of the court.  Hence prays for dismissed as this not pressed in the interest of justice and equity”

Considering the above, we pass the following order:  

ORDER

Accused is convicted for the offence punishable u/s. 27 of the C.P. Act and sentenced to pay fine of Rs.2,000/-, in  default, to undergo simple imprisonment for 3 months.

Execution Application is fully satisfied.
