The appellant is the opposite party in CC:187/06 in the file of CDRF, Kollam.  The appellant is under orders to pay a sum of Rs.10,000/- to the complainant.  The counsel for the appellant has sought for an opportunity to adduce evidence.  It is submitted that he was laid up on account of cardiac arrest and hence could not pursue the matter.  Further we find that is no reasons as such is mentioned in the order.

2. In the circumstances, the order of the Forum is set aside.  The matter is remitted back to the Forum.  The Forum is directed to permit the opposite parties to adduce evidence and dispose of the case on merits.  The order should reflect the reasons also.  The matter stands posted before the Forum on 3/6/2010.

The office will forward a copy of this order to the Forum urgently.
