JUSTICE SHRI.K.R. UDAYABHANU : PRESIDENT

The appellants are the opposite parties/postal authorities in CC.297/05 in the file of the CDRF, Kozhikkodu. It is the case of the complainant, a retired rubber taper that the cheque for Rs.1,30,976/- sent from the office of the Provident Fund Commissioner to his pension account at the 1st opposite party post office was returned by the opposite parties to the sender and the matter was not intimated to the complainant. He incurred considerable loss and underwent mental agony. In fact he wanted to purchase a property by receiving the amount. He claimed a sum of Rs.20,000/- as compensation.
The contention of the opposite party is that as per the rules the amount exceeding Rs.1,00,000/- cannot be deposited in the pension account.
2. The evidence adduced consisted of the testimony of PW1, RW1 the Sub Postmaster and Exts.A1 to A7.
3. The Forum after considering the evidence adduced directed the opposite party to pay a compensation of Rs.3,200/- only.
4. We find that the opposite party has not produced any documents or copy of rules to establish the case that amounts exceeding Rs.1,00,000/- cannot be deposited in the pension account. There is no explanation for not intimating the matter to the complainant also.
5. In the circumstances we find that there is no patent illegality in the order of the Forum. There is no circumstances for the interference of this Commission in the matter.
6. In the result the appeal is dismissed in-limine.
