ORDER

Counsel for the petitioner heard.  The impugned order  of the State Commission, runs as follows :-

17.01.2014

Admit.  Register.

Issue notice to the respondent, fixing 24.02.2014.  Steps be taken within three days.

Heard on the stay application.

The operation of the impugned judgment and order dated 13.12.2013 passed by the District Forum shall remain stayed subject to the condition that the appellants shall deposit 50% of the awarded amount with the District Forum, within a period of 30 days”.

 

2.      Counsel  for  the  petitioner  submits  that  the complainant is not  a ‘consumer’ and he has been asked to deposit 50% of the awarded amount.   We  see  no  flaw in the order  passed by the State Commission.  This is one  of  the conditions prescribed in the Act  itself  that  he  will have to deposit  50% of  the  awarded  amount.

 

3.      The said  amount, on deposit, by the petitioner,  shall not be disbursed  by the District Forum, till  the final disposal of  the  case.  The District  Forum  shall keep  the  said  amount in a short-term FDR, till disposal of the appeal.

 

4.      The State Commission shall decide the issue whether, the complainant  is  a  ‘consumer’  or  not.  The  matter  be  expedited and  be  disposed  of,  preferably,  within  four  months  from  the  date of  receipt  of  this order.

 

5.      The petitioner shall deposit the amount accordingly, and the time stands extended by 15 days, from today.

 

6.      IA 1676/2014, rejected.  Revision Petition stands disposed of.
