Today is fixed for evidence by the Complainant as special chance but no step is taken by the Complainant. OP files hazirah and prays for dismissal of the instant case. The record shows that 20.02.20, 27.03.20, 23.07.20, 16.10.20, 07.01.21, 27.04.21, 15.07.21, 28.10.21, 18.01.22, 11.04.22, 30.06.22, 29.09.22, 04.01.23 and today i.e. 18.04.23 were fixed for filing evidence by the Complainant but in spite of that the Complainant has not filed evidence and no step is taken by the Complainant. The Complainant filed the instant case with the prayer for directing the OPs for taking necessary steps so that the electric coneection for sub-mersible Pump situated at the Complainants land may be effected and directing for redressal of loss incurred by the Complainant for non-supply for the electricity to the extent of Rs. 3,63,000/- upto 30.06.16 and for compensation for mental agony and litigation cost to the extent of Rs. 50,000/- We peruse the materials on record. The record shows that the Complainant has not been taking steps for long period and the Complainant has not filed evidence in spite of giving several opportunities to him. The conduct of the Complainant indicates that he is not at all interested in the instant case and as such he is reluctant to adduce evidence for long period. Under the facts and circumstances it may be presumed that the case of the Complainant has no merit and as such it is liable to be dismissed on merit. In the result, the Consumer case fails. Fees paid are correct. Hence, it is Ordered that the complaint Case No. CC/107/2016 be and the same is dismissed on merit against the OPs. Let plain copy of this order be supplied free of cost, to each of the parties / Ld. Advocate/Agent on record, by hand /by post under proper acknowledgment as per rules, for information and necessary action.
