O R D E R

HON’BLE Mr.JUSTICE HULUVADI G RAMESH : PRESIDENT

  1. This Review Application is filed U/s.50 of CPA, 2019 by the Petitioner/OP to review the order dtd.01.07.2019 passed by this Commission in A/4175/2011 on the grounds that Respondent/Complainant has calculated rate of interest at 12% p.m on Rs.12,55,140/- pursuant to dismissal of the appeal.

We examined the grounds of RA, contents of affidavit sworn in by Mr.Ravikumar.P.A, Assistant Manager Incharge of OP company, order dtd.26.11.2011 passed by the Forum below and order of this Commission dtd.01.07.2019. Accordingly, found satisfy to condone the delay, and to avoid further delay dispensed with issuance of notice of this RA to be served on Respondent/Complainant, since Appellant/Review Petitioner/ OP has shown that a typographical error committed by the Forum below in operative portion of the order while directing OP to pay Rs.1 lakhs along with interest at 12% p.m., In our view, this should have been 12% p.a. and not 12% p.m. Awarding interest at 12% p.m. is unknown to the Interest Act. In such circumstances, Commission order to modify the order dtd.26.11.2011 passed in CC/552/2011 by 2nd Addl., District Forum, Bengaluru holding that Complainant is entitle to recover Rs.1 lakh along with interest at 12% p.a. and rest of the order passed by Forum below is confirmed. Accordingly RA stands disposed of. It is hereby direct the office to enclose the order to the main order to complete the record.  
  1. Send a copy of this Order to the District Commission and parties to the petition for needful.
