The complainant had been enrolled as a member by the OP company which is in the business of hospitality. It is alleged by the complainant that having paid a sum of rs. 17000/-, he was to get six vouchers but was given four only. As he wanted to visit Agra he had taken up the matter with the OP and had informed one Amit( an official of the OP )and had sought a booking for 17.8.2014. The said Amit had informed the complainant that a three /four staff hotel booking had been done in his name but the name of the hotel would be

disclosed on the next day. On the next day on enquiry in the office of the OP , the complainant was told on telephone that the said Amit had not come to the office. The officials of the OP refused to give the mobile number of the said Amit and also did not give any information abou the status of the hotel booking. Therefore, the complainant visited the office of the OP on the next day personally in order to meet Amit and mae an enquiry about the hotel booking .he was again told that the said Amit had not come to the office. However, when the complainant made an enquiry from a peon inside the office of the OP he was informed that the said Amit was very much present in the office. The complainant has alleged that in this matter the Ops had refused to give the promised servides to him. Hence, the complaint.
A registered notice was issued to the OP on 19/11/2014 .The notice was not received back unserved and therefore service was presumed to have been effected on the Ops. Since none had appeared on behalf of the Ops, they were ordered to be proceeded with ex-parte.
The complainant has filed his own affidavit in his exparte evidence and has corroborated the contents of the complaint.
We have heard arguments advanced at the bar and have perused the record.
The complainant has placed on record documents showing that

the OP had given him a membership givenafter charging a sum of Rs. 17000/-. The affidavit filed by the complainant which has remained unrebutted shows that theOP had refused to give due service to the complainant and had rather put him off on one pretext or theother .We are convinced that the OP is guilty of deficiency in service and direct it as under:
1. Pay to the complainant a sum of Rs. 17000/- along with interest @ 10 % p.a. from the date of institution of this complaint i.e. 18.11.2014 till payment.
2.Pay to the complainanta sum of Rs 15000/- as compensation for pain and agony suffered by him.
3.Pay to the complainant a sum of Rs. 2,500/- as cost of litigation.
The OP shall pay this amount within a period of 30 days from the date of this order failing which they shall be liable to pay interest on the entire awarded amount @ 10% per annum. IF the OP fail to comply with this order, the complainant may approach this Forum for execution of the order under Section 25/27 of the Consumer Protection Act.
Copy of the order be made available to the parties as per rule. File be consigned to record room.
