Case is posted today for Order on memo Dt. 02/07/2019 filed by the JDR which was received by the DHR on Dt. 22/07/2019 and argued on the point of petition by both of the parties on the same day.
Having gone through the memo and oral submission advanced by both of the parties and on perusal of on order passed by this Honble forum in connection with the misc. petition Dt. 20/07/2016, it came to our notice that the misc. petition is allowed in favour of the JDR/OP. exogenerating him from any liabilities on the ground stated therein, in the same order.
In the meantime the DHR has filed a petition to issued notice the JDR to handover the repaired cooler to DHR.
However, in view of such circumstances the memo filed by the JDR is allowed and the petition by DHR is rejected.
Accordingly the case is disposed off today in the open Forum.
