1. This is an application U/s 12 of the C.P.Act, 1986.
2. The complainant’s case in brief is that, he had LP Gas connection. His consumer number was 11077. He was regularly using the Gas cylinder. In the month of March, 2015, the OP.2 stopped delivery of the Gas cylinder to the complainant. When asked by the complainant, the staff of the OP.2 agency replied that no Gas cylinder would be delivered to him. Therefore, the OPs committed deficiency in service and unfair trade practice. Hence this case.
3. On the other hand, the OPs did not appear in the case, as such they were set exparte and exparte hearing is taken up on 06/11/2023.
4 Perused the materials on record. Admittedly, the complainant is a customer of LP Gas. He had booked LP Gas till 23/01/2015. But it is alleged by the complainant that, in the month of March, 2015, no Gas cylinder was delivered to him. There is no proof on record that he had booked the Gas cylinder but it was not delivered to him. The mere complaint that the Gas cylinder was not delivered to him, will not amount to deficiency in service or unfair trade practice unless it is proved that he had booked the Gas cylinder but despite that, the Gas cylinder was not delivered to him. Such evidence is wanting in this case. As such, the complaint is devoid of any merit. Hence it is ordered.
ORDER
The complaint is dismissed exparte against the OPs being devoid of merit.
The order is pronounced on this day the 20th November, 2023 under the seal & signature of the President and Member (W) of this Commission.
