As the point involved in all these matters is one and the same, these E.As are disposed of by this common order.
On 26-6-2014 this Commission passed a docket order in the following lines:
“The learned counsel representing Maytas Properties Limited states that within a period of two weeks the property will be registered in favour of the complainant(s). In those circumstances, the matter is directed to be listed after two weeks. Post on 10-7-2014 for orders’.
Today when this matter is taken up for hearing, both counsel submitted that the entire sale consideration that was paid by the petitioner/complainant was repaid by the respondents/opposite parties i.e. M/s. Maytas Properties Ltd., and in those circumstances the question of registering the property does not arise.
It is further submitted by the learned counsel for the respondents that as the entire sale consideration was returned, the complainant has to execute a deed of cancellation of the registered documents which were entered into between the parties at the time when the transaction had taken place.
Accordingly these E.As. are closed with a direction to the petitioner/complainant to execute cancellation deed with regard to those documents which were registered at the time of parties entering into those particular transactions. The costs for such cancellation shall be borne by the respondents/opposite parties. Any other interlocutory applications pending in these E.As. also shall stand closed.
