- The complainant has filed the present complaint U/s. 17 (a)(i) of the Consumer Protection Act, 1986 prays to direct the opposite party no.1 to refund Rs.70,26,118/- along with future interest @ 18% P.A., treat the Registered Sale deed and Agreement for construction dated 26th May, 2008 between the complainant and the opposite party no.1 as having been rescinded and therefore direct the opposite party No.1 to clear the entire loan amount along with interest and penalties, if any, to the respondent no.2, to award Rs.7,00,000/- towards mental agony and harassment and costs.
- Joint Memo dated 06.09.2016 filed by the complainant and the opposite party no.1 submits that both the parties have reached an amicable settlement and as per the settlement reached between the complainant and the opposite party no.1, the complainant has received a sum of Rs.456,08,340/- ( Rupees Forty Five Lakhs Eight Thousand Three Hundred and Forty Only ) vide cheque No. 021964 dated 30.06.2014 drawn on ICICI Bank Limited, Kharkana Branch, Secunderabad, from opposite party no.1 towards full and final settlement and acknowledges that there are no further claims against the opposite parties. In view of the above, the complainant is withdrawing the above Consumer Case No. 102/2014. Hence it is therefore prayed that the Hon’ble Telangana State Consumer Disputes Redressal Commission, Hyderabad may be pleased to permit the complainant to withdraw the above Consumer Case by granting leave in the interest of justice.
- Heard the counsel on both sides. Memo recorded. In view of the compromise between the parties, the complaint is dismissed as withdrawn.
