Presented by Smt. Jigeesha Mishra, President:-
1) The case of the Complainant is that the Complainant is a bonafide consumer of Opposite Parties bearing Consumer No.512124080240 and paid the electricity bill regularly. In the month of April-2022 the Complainant showed that the meter issued to the Complainant was running speedily, erroneously and the meter is a defective one. Thereafter the Complainant reported the matter before the Opposite Parties. One of the representative of the Opposite Parties came and told that the meter is defective one and as soon as possible they will change the meter. Thereafter the Complainant approached to the Opposite Parties many time to change the defective meter but the Opposite Parties deferred the matter many time. In the month of April-2023, the Opposite Parties issued a bill to the Complainant in which the Opposite Parties demanded an amount of ₹ 52,731/-(Rupees fifty two thousand seven hundred thirty one)only without any basis. The Opposite Party demanded that amount and threatened to disconnect the electricity. Hence the Complainant filed this case before this Commission.
2) The case of the Opposite Parties is that the Opposite Parties did not appear and set ex-parte.
3) Perused the complaint petition and documents filed by the Complainant and it reveals that the Complainant filed some bills only. The Complainant pleaded in his petition that the meter was defective one and he has approached the Opposite Parties many time to change the defective meter. But no any document was filed by the Complainant about the defective meter. The Complainant not filed any document when he approached the Opposite Parties. The amount of ₹ 52,731/-(Rupees fifty two thousand seven hundred thirty one)only was charged by the Opposite Party. But the Complainant has to prove that the amount was illegal. But the Complainant did not clarify about it Billing dispute will not coming under the perview of consumer commission. Separate authority is there for solving billing dispute.
As per supra discussion the following order is passed.
O R D E R
4) As the case related to billing amount, the Commission has not authority to entertain this case and the Complainant is directed to approach appropriate authority. Accordingly the complaint case is dismissed with no cost.
5) Accordingly the order is pronounced in the open Commission to-day i.e. Dt.16/07/2024 and the case is dismissed against the Opposite Parties and disposed off.
