The case of the complainant in short is as follows.

The complainant purchased a new Exide 150 AH battery from the opposite party.  The product has 3 years warranty.   The product became defective during the warranty period and entrusted to the opposite party for getting  it repaired.   Opposite party assured to replace the same.  But till now the product has not been replaced .  The complainant sustained much mental agony and hence filed this complaint.  

2. Notice was served to the opposite party but they did not appear before the Forum and hence  set expartie.  

3. Complainant filed proof affidavit  Ext.A1 and Ext.A2 series were marked.

4. Considering the allegations of the complainant, the Forum has raised the following issues:-  

1)  Whether there is any deficiency in service on the part of the opposite parties?

2)  Whether the complainant is entitled to get any reliefs?

The case of the complainant is that complainant purchased a Exide 150 AH Battery from opposite party on 22/8/2014 for an amount of Rs. 11,200/-  the product has 36 months warranty the product became defective during the warranty period and entrusted to the opposite party for getting it repaired  or replaced.  The opposite party assured to replace the same but it has not replaced so far.  Hence filed this complaint.  The complainant filed proof affidavit and documents Ext.A1 and A2 series were marked.  Ext.A1 is the cash bill dated 22/8/2014.  Ext.A2 series are the   photo graphs shows the warranty.  From the documents it can be seen that purchased INVA MASTER 10000 Exide 150 AH Battery ISF 041318027403 on 22/8/2014 from the opposite arty for an amount of Rs. 11,200/-.  Ext.A2 series shows that product is under warranty.  According to the complainant the product is defective and he could not use the same.   Since defects arose within the warranty period the opposite party is liable to rectify the defect or to replace it.  But the opposite party failed to rectify the defect.  Therefore   they have committed deficiency in service and the complainant is entitled to get relief.  

In the result the complaint is allowed.   The opposite party is directed to replace the defective battery with new one of the same model or for the same price.  The Opposite party are directed to pay an amount of Rs. 500(Rupees Five hundred only) towards cost.  Since the primary relief having been met adequately.  We refrain from awarding compensation.  The Order shall be complied with one month from the date of the receipt of this order
