This is a complaint filed under section 12 of C.P. Act, 1986 praying to direct the opposite parties to replace the defective mobile phone with a new one for the same cost or in the alternative to refund the cost of mobile i.e., Rs.6,299/- along with interest @ 24% p.a. from the date of purchase i.e.,24-4-2010 to till the date of realization and to pay Rs.10,000/- towards deficiency of service and for adopting unfair trade practice by way of selling defective mobiles, Rs.5,000/- towards compensation for causing mental agony and Rs.2,000/- towards costs of the complaint.  

 This C.C. coming on before us this day in the presence of  Sri M. Chennaiah Goud, Advocate, Mahabubnagar for the complainant and OP-2 in person and the OPs.1 and 3 having been set exparte and having stood over for consideration till this day, this Forum delivered the following:

           In view of the memo filed the matter is advanced to this date.  The complainant filed memo stating that in view of the amicable settlement between both the parties, OP-2 paid an amount of Rs.6,000/- to him as a final settlement, as such the complaint can be dismissed as not pressed.  The memo is accordingly recorded.  In view of the memo filed, the complaint is dismissed as not pressed.  No costs. 

   Pronounced by us in the open Forum, on this the 29th day of July, 2011.
