- The Complainants have purchased FDR No. 001010012419 dated 28.11.2019 in the name of Shreeya Rani Dora from Big Bazar, Modipara, Sambalpur which was subsequently taken over by Reliance Smart. Since 21.11.2022 the FDR got matured but the O.Ps not deposited the maturity value in the designated account submitted with O.Ps. Likewise. FDR No. 00101003363 dated 18.12.2019 was purchased in the name of Complainant No.2 Baby Rani Dora and matured on 16.12.2022 but the maturity value was not paid. On several approach also when the O.Ps remained silent on 01.08.2023 notice was given but the O.Ps remained silent. Sushanta Kumar Dora husband of Complainant No.2 and father of Complainant No.1 is undergoing treatment in Tata Memorial Hospital Mumbai and he could not got the amount for treatment. Being aggrieved complaint was filed.
- Perused the documents filed by the Complainants. FDR No. 001010012419 was issued on 28.11.2019 for Rs. 70,000/- and maturity date was 21.11.2022 for Rs. 95,111/-. Likewise FDR No. 00100013363 dated 18.12.2019 for Rs. 70,000/- was issued by O.Ps and maturity date was 16.12.2022 for Rs. 95,111/-. The Complainants have filed treatment registration receipt of Sushanta Kumar Dora and notice dated 01.08.2023.
- From the documents filed it reveals that the Complainants have approached the O.Ps several times to the O.Ps and lastly sent notice dated 01.08.2023 but the O.Ps remain aloof. Non disbursement of maturity value after demand also in favour of complainants amounts to deficiency in service. After receipt of notice also the O.Ps remain silent, it amounts to unfair trade practice.
Notice was issued to the O.Ps but the O.Ps did not turn up. Accordingly, the O.Ps were set ex-parte.
Basing on the documents submitted Supra, the following order is passed:
ORDER
The complaint is allowed ex-parte against the O.Ps. The O.Ps are directed to refund Rs. 95,111/- with 12% interest P.A. w.e.f. 22.11.2022 to the Complainant Baby Rani Dora and Rs. 95,111/- with 12% interest P.A. w.e.f. 16.12.2022 to Complainant Shreeya Rani Dora within one month of this order. In case of non-payment the amount will carry 15% interest till realisation. For deficiency in service the O.Ps are liable to pay compensation of Rs. 1,00,000/- and litigation expenses of Rs. 10,000/- jointly and severally.
