- The case of the Complainant is about the deficiency in service intentional negligence, cheating and causing intentional harassment to the Complainant by the O.Ps. The Complainant is a policy holder of Sahara India and has deposited Rs. 30,000/- on dtd. 23.12.2013 for period of 96 months as fixed deposit. The aforesaid accounts have already matured since 23.12.2021 and maturity amount is Rs. 78,360/-. As per the terms and conditions of the said policy the Complainant claimed in the office of the O.P. to get his legitimate maturity amount in the prescribed format, since the date of maturity in the prescribed format. Since the date of maturity, the Complainant is running and approached several time to the O.P. but the O.P. has not paid the maturity amount. Hence this case.
- The written version of the O.P. is that under direction of Hon’ble Supreme Court a sum of Rs. 5,000 crores have been transferred to the Central Registrar Co-operative Society for disbursement of legitimate dues of Sahara Group of Co-operative society. In view of the order dtd. 29.03.2023 passed by the Hon’ble Apex Court, the Complainant in the present matter be directed to file his application for procurement of maturity amount to the CRCS for verification and subsequent realization of the same. In light of the aforementioned facts, circumstances and legal aspects, the case is liable to be dismissed.
- After perusing the evidences, case records and documents, the accounts of the Complainant have matured on 23.12.2021 and out of several request and claim in proper format by the Complainant, the O.P. failed to pay the maturity amount in time. Heard earnings of the Complainant when blocked, not paid in time, the O.P. remained silent, this complaint was preferred. The O.P. harassed the Complainant and compelled to sort Redressal before the Commission. This amounts to deficiency in service on the part of the O.P. and violation of contract.
Accordingly it is ordered:
The Complainant is allowed on contest. The O.P. is directed to pay the maturity value of fixed deposit Rs. 78,360/- along with 7 % interest P.A. w.e.f. date of maturity i.e. 23.12.2021 within one month of this order to the Complainant. Further the O.P. is directed to pay compensation of Rs. 20,000/- to-wards harassment and mental agony and Rs. 10,000/- towards litigation cost to the Complainant within one monthfrom the date of order failing which the amount will carry 12% interest P.A. till realisation.
